Christiane Deniger to speak at London Arbitration Week
Christiane Deniger, Director at Burford Capital, will speak at the panel, “Linklaters' 2026 ISDS Empirical Study: Costs, Damages and Duration in Focus." The session will take place on December 3 at 8:30am GMT in London.
In this session, Linklaters will unveil the findings of Linklaters’ 2026 ISDS Study, a new edition of Empirical Study: Costs, Damages and Duration in Investor-State Arbitration. Building on the three earlier studies published in 2014, 2017 and 2021, this new edition considers over 200 additional investor-State cases and ICSID annulment decisions issued between 1 June 2020 and 31 May 2026, bringing the total dataset under examination to over 700 investor-State cases and ICSID annulment decisions.
Drawing on this updated dataset, the discussion will offer a data-driven perspective on the trends shaping the present and future of investor-State dispute resolution. Both investors and States have a shared interest in greater certainty on how long ISDS proceedings take, what they cost and how tribunals approach the allocation of those costs – questions that remain central to the reform agenda of UNCITRAL Working Group III, whose policy paper on procedural efficiency drew heavily on the 2017 edition of the study.
Against that backdrop, the panel will explore what the latest evidence reveals about the duration, cost and outcomes of investor-State proceedings, and how empirical data can inform ongoing debates around legitimacy, efficiency, accessibility and the overall design of the system.
