Jeffery Commission, Director at Burford Capital, will speak on the panel, "Investment Projects, Arbitration, and the Communities Caught in Between," at Washington Arbitration Week on October 27 at 3:00pm EDT in Washington, DC.

The session will examine the complex relationship between investment projects, arbitration and the local and Indigenous communities affected by major infrastructure and development projects. Panelists will explore how tribunals are approaching disputes involving community opposition, including questions around investor responsibility, state obligations and the role of human rights and environmental considerations in investment arbitration.

The discussion will also consider whether evolving treaty provisions, including investor obligations, consultation requirements and benefit-sharing mechanisms, are creating a greater role for affected communities in the investment arbitration framework.
