Response to Renewed Proposal to Amend Fed. R. Civ. P. 26(a)(1)(A)

Earlier today, Burford Capital wrote to the Advisory Committee on Civil Rules to address a proposal by the U.S. Chamber Institute for Legal Reform to amend Rule 26 of the Federal Rules of Civil Procedure.

In its proposal – which the Committee already declined to adopt in 2014 and again in 2016 – the Chamber urged the Committee to amend Rule 26 to “require the disclosure of third-party litigation funding arrangements in any civil action filed in federal court.”

The Chamber’s renewed request does not merit the Committee’s reconsideration. The full text of Burford’s letter to the Committee is available here.
