Burford Managing Director Andy Lundberg provides expert analysis on a recent decision related to property insurance cases and Covid-19.
The decision in Cajun Conti LLC et al. v. Certain Underwriters at Lloyd's, London et al., reinforced the policyholder argument that "the presence of noxious or toxic substances like the coronavirus causes covered physical damage."
Lundberg states, "Courts can be open to the suggestion that insurers should bear responsibility for not defining 'physical damage' and not excluding viruses when they had ample reason and ample opportunity to do so."
